
The fastest way to get divorced is for the two spouses to agree on all issues and avoid a contested divorce. The faster the spouses agree on the issues the faster they can get divorced and end the marriage.
If an agreement is reached before filing for divorce the parties can file an uncontested divorce which is called a 1A divorce. In Massachusetts, spouses who agree on all major issues can file a Joint Petition for Divorce under Massachusetts General Laws c. 208, §1A.
Because there is no trial and no dispute for a judge to resolve, the case moves much faster than contested divorces. In most cases, after a 1A divorce is filed a hearing is held before a judge in 1–3 months depending on the county and court schedule. After the hearing: a 120-day waiting period occurs before the divorce becomes final (Judgment of Divorce Absolute)
It is not unusual for contested divorces to take 2 or 3 years. Fortunately, this time can be shortnened if the couple reaches an agreement. Most delays in divorce come from conflict, not from paperwork.
An agreement to settle a divorce requires that both parties have full knowledge of the finances of their spouse. This means that both parties have to exchange accurate financial information early. Nothing delays a divorce more than hiding or transferring assets. It is hard to settle the case when you know that your spouse is hiding money.
